Where the Facts Lead

Advocacy is not easy.

As a human rights advocate you see the ability of human beings to dehumanize other human beings, often for financial game and, almost as often, so those doing the dehumanizing can feel powerful, though it takes no power to dehumanize someone, just an ability to be heartless. You see lives lost, figuratively and literally.

I hold fast to something Dr. Martin Luther King Jr. once said. “"The ultimate measure of a man  is not where he stands in moments of comfort and convenience, but where he stands at a time of challenge and controversy. The true neighbor will risk his position and even his life for the welfare of others." Is is easy to hold fast in times of challenge and controversy?  No, of course not. It can be brutally hard, scary, painful, and, at times, deeply lonely. But I can live with all that. What I can’t live with, what is far more painful, is the task of staying silent when bigotry and discrimination is at work.

Perhaps one of the most grueling things for me is when I see other advocates set aside their advocacy when it is a friend or family member or business colleague or revenue source doing the dehumanizing. Staying silent, or turning a blind eye when people are being denied their rights, or are being misled, lied to, hurt, is not in my repertoire. In my more selfish moments, I wish it was, but it is not. It is painful when people you know stay silent when someone they happen to know is doing the dehumanizing, the discriminating. I’ve had some who I’ve admired and genuinely liked lash out at me when my advocacy efforts bump into members of their inner circle.

I can’t help where the facts lead.

Once, many years ago, I worked for a long-term healthcare facility in the Bronx. The company held a Christmas Party in a restaurant’s basement level banquet hall. To get to the hall you had to walk down a very long steep flight of stairs. There were no bathrooms on the same floor as the hall and, there was no elevator. This, of course, posed a problem for a good friend of mine who, like me, worked for this healthcare company and was a wheelchair user. Jim Cesario is about as dazzlingly good with a wheelchair as one can get, but still, rolling down a steep flight of stairs and then up again when you had to leave or, say, use the bathroom, would be rather difficult.

Anyway, once I’d learned of the set-up I announced I would not attend the party. Jim along with his wife and daughters were not going, for obvious reasons, and several staff members decided not to go in protest because of the sites inaccessibility. Marked as the ring leader, I was called into the administrator’s office where a few things were explained to me. Yes, they knew this was not fair to Mr. Cesario but after all he was the only wheelchair user on staff and they’d gotten a really good discount price for the hall. And secondly, didn’t I understand that my refusal to go was a blatant sign of disrespect for the company owner and the company as a whole? I said it didn’t make a difference if it was one wheelchair user or dozens, and as far as disrespecting the owner was concerned, perhaps the owner and all members of upper management ought to consider how they’d feel if they had to be carried up and down stairs – in front of their spouse, children and co-workers no less! – every time they needed to use the bathroom.

Needless to say, the party was held in the basement hall. I didn’t go. What’s worth noting is the party was thrown by a healthcare company that would tell the world it fully supported equal rights for wheelchair users, unless of course there was a discount to be had.

And then, in recent history, I uncover the fact that Tim Feeney was lying when he told – and continues to tell -  the world that he is Dr. Feeney or Tim Feeney PhD, when the only valid college degree he has is a bachelors. For fifteen years he was arguably the most powerful voice in the implementation of New York State’s Traumatic Brain Injury Waiver, a form of Medicaid reimbursement for survivors of brain injury living in the community. During that time Feeney would dictate policy and procedures to companies providing waiver services, inflict admission holds, direct that some survivors  be removed from the waiver or stop others from getting on the waiver.

Now you would think that when the truth was revealed, the advocacy community, not to mention the survivors, their families and providers would be glad. Most were. But some attacked me for bringing the truth into the light. Why? In some cases it was because Feeney was linked to people they liked and were friends with, namely former New York DOH employee Patricia Green Gumson and current DOH employee Bruce Rosen.  Both oversaw the waiver for many years and did many truly good things during that time. However, investigation of Feeney revealed there was ample reason to believe both both Gumson and Rosen knew about Feeney’s misrepresentation and covered for him.

I can’t help where the facts lead.

And now it again appears that Feeney may be given the same powerful position in the waiver even though the DOH and STIC (Southern Tier Independence Center) in Binghamton, the company likely to be awarded the contract with DOH that may lead to Feeney’s return, are fully aware of Feeney’s dishonesty. Needless to say I’ve already had people reach out to me telling me that STIC is a highly reputable center. They are right. It is. But even the best of us, myself included, make mistakes in judgment sometimes. Do we deserve to be villainized? No. Do we deserve to be held accountable? Yes.

Which is exactly what I am doing.

Tim Feeney, John Mccooey & NY State DOH

Sources say Belvedere Brain Injury Program owner John Mccooey may be behind an effort to get Tim Feeney another contract with the New York State Department of Health to again oversee the Neurobehavioral Project for the state.  State officials are looking into the matter. Belvedere has sites in Albany and Syracuse.

Tim Feeney had three consecutive five-year contracts with the NY DOH to oversee the Neurobehavioral Project despite the fact his doctorate and masters degrees are bogus, not recognized as valid anywhere in the world. In his last years under contract, Feeney and Mccooey worked closely to develop a substance abuse program for Belvedere that, sources say, continues to deny participants choice and in some instances locks the doors when workshops begin, telling participants they will not be allowed back in if they have to use the bathroom or go for a drink of water.

Feeney is currently under contract with the Fort Ann School District in Washington County New York  to work with children, including children with disabilities and is again representing himself as Dr. Feeney or Tim Feeney PhD. School officials, including Fort Ann School Superintendent Maureen VanBuren, have been told about his bogus degrees but it seems they are continuing to work with Feeney anyway, the welfare of the children be damned.

Some Background

On more than once occasion I have been asked what led me to investigate and  Feeney’s credentials, or, as it turned out, his lack thereof.  Some think it is because when I was forced out of Belvedere, John Mccooey said Feeney made him do it. First of all, by the time Mccooey told me that he had about as much right to claim the mantel of honesty as Willie Sutton had to a job as bank manager. Mccooey’s finger pointing at Feeney is not what led me to investigate the on again off again rumors that Feeney’s credentials were, in a word I feel comfortable using in this blog, bullshit. What led me to investigate his credentials was a change in his, Feeney’s, pattern of behavior.

One of the things they teach you in behavior management is that a change in a person’s common behavior pattern means something. In 2007 it had become clear that my advocating for the rights of those participating in Belvedere’s Albany substance abuse program was going nowhere. Participants were being talked to in degrading ways by Belvedere employee Michael Loiselle, they were being denied choice as provided for in the regulations and in their rights as human beings, and John Mccooey was doing nothing about it. At the time I had a close relationship with Pat Green Gumson and Bruce Rosen in the Department of Health. I reached out and let them know that there were real problems and something needed to be done. Feeney and his crew were sent in to deal with the problems. Historically, when the DOH caught wind of participants being denied their rights, they corrected things. Not this time.

This time the punitive rights-denying behavior of Belvedere was supported. There had been a change in Feeney and the DOH’s  normal pattern of behavior.

And so now we are looking at the possibility of Feeney being reinstated and a dysfunctional company owner named John Mccooey being involved.

Equal Rights Will Prevail

Yes, it is disheartening to encounter people like Mccooey and Feeney who apparently see people with disabilities as a way to make money and make themselves feel big and strong (both men are wimps, by the way). But do not give up. There are in fact, some good people in the New York State Department of Health and there are some truly good people in the advocacy community who offer more than simply lip service to the cause of equal rights. I can tell you that in those rare moments when I get down, I remember Mandela, King, Elie Wiesel, Simon Wiesenthal, Rosa Parks, Gloria Steinem and countless others; God knows they paid heavier dues than I have. So no, I will never give up and I hope you won’t either.

Feeney Again – This Time Targeting Children

This time it’s children.

Timothy J. Feeney has contracted with the Fort Ann Central School District in New York’s Washington County to work with children with behavioral issues, including, but not limited to, children with autism. In his contract with the district and in the resume he presented to the district, Mr. Feeney represents himself as having a valid PhD and masters degree and he doesn’t. District Superintendent Maureen VanBuren and district school members have been informed, but to date there is no reason to believe the district has severed its contract with Mr. Feeney.

I am not unique when I lay claim to a special form of disgust and anger when I see children being targeted. To portray yourself as Dr. Feeney or Tim Feeney PhD and then impact the lives of children, including children with disabilities no less, is both unconscionable and potentially dangerous for this child.

Apparently Feeney has no problem misleading the public, and one has to wonder about his staff as well, given the fact since it was revealed in 2008 that he is misrepresenting his credentials. Staff members Melissa Capo, Paul Akers and James Feeney were with him at the time. Feeney’s company website certainly wants you to think he is Dr. Feeney. It is no surprise that nowhere does he mention Greenwich University in his bio.

Mr. Feeney’s PhD and Masters were issued by a now defunct diploma mill called Greenwich University, pretty much a by-mail course since Greenwich University was located on Norfolk Island off the coast of Australia. When Mr. Feeney took advantage of its services he was living in New York.

If Feeney’s website’s claim that he “travels the world over speaking to audiences about collaborative supports for individuals with brain injury, autism and related disorders, and individuals with challenging behaviors” appears accurate. One has to wonder what impact he has. After all, he is misrepresenting his credentials to families and their children, around the world.

According to District Superintendent VanBuren, the district has no specific policy to vet potential contract employees. You would think the parents and community would be up in arms over this. There is no excuse on God’s green earth for putting children at risk.

Mr. Feeney did not respond to a written request for comment.

Feeney Charade Continues

Timothy J. Feeney continues to present himself to the world as Tim Feeney PhD when his “degree” is not recognized as valid anywhere in these United States. Mr. Feeney himself has admitted his degree is not recognized as valid in the United States. But this hasn’t stopped him from continuing to present himself to survivors of brain injuries and schools as having a doctorate. His willingness and the willingness of those who know of the bogus degree and enable its use shows a hideous amount of disrespect for those who deserve honest and honorable health care services, it shows no respect for the thousands who’ve worked mightily to get real doctorates.

The following is an article from the Life Growth Blog published in February 2009. Mr. Feeney’s contract with the state expired the 31st of last year. It is wrenching to think that some of Mr. Feeney’s targeted customers are school children. There is a new website that is worrisome.

TO DEGREE OR NOT TO DEGREE, THAT IS THE QUESTION

To his credit, Timothy J. Feeney, a contract employee with the New York State Department of Health for nearly 15 years, recently acknowledged that his PhD was issued by a college that is not accredited in the United States.


In an unsolicited February 8 e-mail to readers of this blog, Mr. Feeney said he received his PhD from Greenwich University which, he writes, “functioned as an unaccredited institution in the US, moved it’s physical location to Australia, received legal accreditation in Australia for a two year period – period of time that my doctorate was conferred – and then lost that accreditation and closed) and no longer exists.”

Mr. Feeney appears to be partly correct. The Greenwich University Act of 1998 allowed Greenwich to function on Norfolk Island as a recognized university. However, according to a web-alert issued by the Australian Government, degrees issued by Greenwich were never recognized as valid on the Australian mainland and they have never been accredited anywhere in the United States.

According to an e-mail from Douglass Capogrossi, past president of Greenwich University and current president of Hawaii-based Akamai University (also non-accredited), Mr. Feeney is correct that his doctorate was issued when the Greenwich University Act of 1998 was in effect.

According to Mr. Capogrossi, Mr. Feeney’s doctorate was issued on June 14, 1999 and his masters degree, also from Greenwich, was issued on August 27, 1993, before Greenwich moved to Australia and five years before the Greenwich University Act when, according to Mr. Feeney’s e-mail, Greenwich was operating as a non-accredited school in the United States.
Greenwich University was located in California and Hawaii in the 1990s before relocating to Norfolk Island off the coast of Australia. It closed in 2003.

In his e-mail Mr. Feeney expressed concern that this writer was or is about to call him a fraud or accuse him of fraud. As I said to him in a subsequent e-mail, I have no intention of doing either.
In his e-mail Mr. Feeney further says I have drawn a conclusion about the academic integrity of degrees issued by Greenwich and “based (my) opinion on the fact that (his) Masters and Doctorate have been conferred by Greenwich University, which he has, in separate emails to myself and others, characterized as a Diploma Mill.”

Rightly or wrongly, Greenwich University is on numerous diploma mill/non-accredited schools lists on the web. The State of Oregon has compiled a comprehensive list of non-accredited schools and Greenwich is listed. It is also present on a non-accredited school lists that can be located by visiting the website for the U.S. Department of Education.

As one who lives with a brain injury and one who advocates for all people with disabilities, it is true that I wrote Mr. Feeney e-mails asking him to clarify his education. He never responded to any of my requests. In fact, his e-mail to the readers of this blog represents the first time I have heard him acknowledge his doctorate was issued by Greenwich University.

Moreover, in his unsolicited e-mail to readers of this blog, Mr. Feeney says he is “very careful never to refer to myself as a psychologist.” However, his profile in his company website says (italics are mine) “Tim has worked in a variety of capacities in human services including: special education teacher, program director of a state program for individuals with autism, coordinator of educational services, coordinator of behavioral services, staff psychologist, consulting behavior specialist, and an Assistant Professor of Special Education.

The issue for me is whether or not someone who has worked in the field of brain injury in New York State and a wide array of other localities has degrees that are recognize as valid by accrediting and regulating agencies.

However, according to Mr. Feeney, the New York State Department of Health is satisfied with his degrees and the NYDOH is fully aware that they were issued by a school that is not accredited in the United States.

In his February 8 e-mail he writes “I have been the Project Director for the NY State Neurobehavioral Resource Project for nearly 15 years, representing 3 distinct 5 year award periods. I have this job as the result of responding to a Request for Applications on three separate occasions. Each application required that I present my credentials for review. In each project award period I have been identified as the “key person” as a result of the DOH’s recognition of my experience and success as a clinician supporting individuals with brain injury and challenging behaviors. The Department of Health, the state office responsible for the Neurobehavioral Resource Project, is well aware of my educational history, the source of my degrees, and knew that I was undertaking graduate studies while working as the Project Director.”

I have offered more than once to sit down with Mr. Feeney and when he forwarded me the e-mail he sent to readers of this blog I again offered to sit down and talk with him. There has been no response.”

Feeney Era Ends

Timothy J. Feeney’s reign over the New York Traumatic Brain Injury Waiver has likely come to an end.

Sources say the New York State Department of Health has chosen not to seek proposals for the contract now held, for all intents and purposes, by Timothy J. Feeney. If correct, Mr. Feeney’s contractual relationship with the DOH, which made him the director of a project that was arguably the most powerful influence over the implementation of New York’s Traumatic Brain Injury Waiver, ended on September 30.

While the Feeney era may be over now, there is concern the DOH will send out requests for proposals and the company awarded the contract will turn around and hire Mr. Feeney. This advocate would urge the DOH to send out a request for proposals because Waiver Providers and those receiving services from these providers deserve a highly trained team of experts to turn to for support and guidance. However, this time I would urge the DOH to set a higher bar in its proposal request and make sure that those involved in the project are truly qualified and represent the spectrum of experience best equipped for the job: neuropsychologists, family members, survivors and so on.

For 15 years Mr. Feeney misrepresented his credentials to brain injury survivors, their families and waiver providers. He claimed he had a masters then a PHD  when, in fact, he had neither. In print publications and on the net he falsely refers to himself as Dr. Feeney or Timothy J. Feeney, PhD.  His “degrees” were issued by Greenwich University, a diploma mill that was located in Hawaii and California in the 1990s before moving its operation to Norfolk Island off the coast of Australia in 1998. Greenwich University, not to be confused with the prestigious University of Greenwich in England, graces numerous diploma mill lists on the net. It closed its doors in 2003.

However, even though his false credentials have been thoroughly exposed and documented, it appears shame and conscience have little impact in Mr. Feeney’s decision making. Last week I gave a speech for St. Lawrence NYSARC in Canton, New York (NYSARC, by the way, is one of the shining stars in healthcare from where I sit). My speech was in the morning. Mr. Feeney gave a speech that afternoon. When I opened the program I saw it;  he was listed as Timothy J. Feeney PhD and, in several places was referenced as Dr. Feeney. Some people never learn.

Last week I received two letters pertaining to this situation. One came from the Office of the Medicaid Inspector General. They have referred the Feeney matter to Dr. Richard Daines, the New York State Health Commissioner, for investigation. The second was from New York State Attorney General Andrew Cuomo’s office. They too are carefully considering the matter.

And the beat goes on.
